Sell Your Property with Affordable Plus Conveyancing

 

 Selling your home or investment property should be smooth and stress-free. At Affordable Plus Conveyancing, we guide you through every step, making sure your sale is legally sound, your rights are protected, and your timeline is met. PROCESS TO SETTLEMENT

In NSW, you must have a Contract for Sale ready before your property can be marketed. This means:

  • Affordable Plus Conveyancing prepares your Contract for Sale with all legally required documents (title search, zoning certificate, sewer diagram, etc.).
     
  • We review your details carefully to ensure the contract is accurate and protects your interests.
     
  • If needed, we include special conditions to suit your sale situation (e.g., delayed settlement, early access).
     

Once your contract is ready, your agent can start advertising the property.


 

A sale becomes legally binding only when contracts are exchanged. This happens when:

  • The buyer and seller sign identical copies of the contract.
     
  • The buyer pays the deposit (usually 10%, unless otherwise agreed).
     
  • The contracts are dated and marked as exchanged.
     

Until this point, either party can walk away without penalty.

The exchange can be:

1. With a Cooling Off Period

  • Applies to most residential sales unless the buyer waives it with a 66W Certificate.
     
  • During the cooling off period (five business days), the buyer can withdraw by forfeiting 0.25% of the purchase price.
     

2. Unconditional Exchange (No Cooling Off Period)

  • Applies to auction sales, same-day post-auction sales, commercial properties, Company Title, or land over 2.5 hectares.
     
  • Also applies if the buyer provides a 66W Certificate waiving their right to a cooling off period.


 

Once contracts are unconditional, we work toward settlement. This includes:

  • Liaising with the buyer’s solicitor and your real estate agent.
     
  • Confirming any agreed inclusions/exclusions.
     
  • Ensuring any conditions in the contract are met (e.g., repairs, agreed works).
     
  • Coordinating with your bank if you have a mortgage to arrange discharge.
     

The standard settlement period is six weeks, but it can be shorter or longer depending on the agreement.


 

 

On settlement day:

  • We ensure all funds are transferred correctly.
     
  • Your mortgage (if any) is discharged.
     
  • Legal ownership is transferred to the buyer.
     

Once complete, your agent will be authorised to release the keys to the buyer. You can then finalise moving out and focus on your next chapter.
